Who will be registered?

All provinces and territories have elected to implement the "retrospective" option provided in the legislation. This means that sex offenders who were under sentence for a designated offence pdf file - Adobe Reader required [45KB] on the date the legislation was proclaimed will be served a "Notice of Obligation to Comply with Sex Offender Information Registration Act" and be registered.

The legislation is not retroactive - offenders who completed their sentence prior to December 15, 2004 will not be registered.

From December 15, 2004 onward Crown counsel may apply to a Judge for an "Order to Comply with Sex Offender Information Registration Act" after the sentencing of an offender for a designated sex offence. After the Order is granted the offender will be registered on the database.
