Can the Superintendent of Motor Vehicles review driving prohibitions made under section 259 of the Criminal Code and section 98 or 99 of the Motor Vehicle Act?

The Office of the Superintendent has no jurisdiction to review these types of driving prohibitions.

Can 12-hour driving suspensions under section 90.3 of the Motor Vehicle Act be appealed?

There is no appeal mechanism or provision to directly remove this type of suspension from your driving record under the governing piece of legislation. If you disagree with the suspension, you may lodge a complaint with the police detachment. The police detachment will be identified on the notice of suspension.

Can 24-hour prohibitions under section 215 of the Motor Vehicle Act be appealed?

If you have been issued a 24-hour prohibition due to alcohol, you may request a written review by the Superintendent of Motor Vehicles if the prohibition was served on or after January 17, 2005. Applications for review must be made within 7 days of the date of the Notice of 24-Hour Prohibition.

How do I find out when my prohibition under Section 93 of the Motor Vehicle Act expires? How do apply for re-instatement of my driver's licence?

To determine when your driving prohibition expires or how to apply for a re-instatement of your licence, call ICBC at 1-800-950-1498 or 978-8300 if you are calling from the Greater Victoria area.

I have received a Notice of Intent or Prohibition in the mail. How do I apply to have my prohibition under Section 93 of the Motor Vehicle Act reviewed?

You may mail a submission to the Superintendent of Motor Vehicles to explain why you believe the prohibition should be reduced or cancelled. Your notice tells you where to send this information. If you did not receive a notice but know that you have been prohibited from driving, send a letter outlining the reasons why the prohibition should be reduced or cancelled to:

Please be aware that sending a submission does not stay a prohibition.

How will I be informed of the decision on my review?
If you have sent a letter asking for your driving prohibition to be reconsidered, you will be informed of the decision by regular mail. Reviews are completed in the order received.
